Terms and Conditions for the SirPrep Mobile App

1. Provider and Scope
The provider of SirPrep and your contractual partner for the App is:

SirPrep is made available through the Apple App Store. By downloading, installing, subscribing to, or using the App, you agree to these Terms. If you do not agree, you may not use the App.
Apple's App Store terms, Apple Media Services Terms and Conditions, and Apple payment rules also apply to your download, in-app purchases, subscriptions, refunds, and use of Apple services. In relation to App Store payment processing, Apple's terms may apply in addition to these Terms.
2. Description of Services
SirPrep is a meal-planning app for personal use. The App helps you create and manage:
- meal-planning preferences;
- weekly meal plans;
- AI-generated meal options and recipe steps;
- grocery lists;
- estimated meal costs and nutrition values;
- meal feedback and saved meal history.
The current iOS App does not require a user account. Most app data is stored locally on your device. Certain features, especially AI generation, subscription validation, and usage quota checks, require internet access and third-party services.
SirPrep may offer free features and paid subscription features. The exact feature set available to free users and paid subscribers may be shown in the App, on the App Store product page, or in the App Store purchase flow.
3. No Medical Device or Medical Advice
SirPrep is not a medical device within the meaning of Regulation (EU) 2017/745 on medical devices.
SirPrep does not provide medical advice, medical diagnosis, medical treatment, or professional dietary advice. Meal suggestions, nutrition targets, calories, macronutrients, fiber values, recipe steps, ingredient suggestions, and food-related insights are provided for general informational and personal planning purposes only.
You must not rely on SirPrep for medical decisions, allergy management, treatment of medical conditions, eating-disorder management, pregnancy nutrition, pediatric nutrition, or any other health-critical decision. Always consult a qualified healthcare professional before making significant dietary changes or if you have allergies, intolerances, illnesses, or other health concerns.
4. AI-Generated Content
SirPrep may use artificial intelligence to generate meal plans, recipes, grocery suggestions, and related content.
AI-generated content may be incomplete, inaccurate, unsuitable, outdated, or unsafe for your individual circumstances. It may misestimate prices, ingredients, allergens, cooking times, calories, nutrition values, or recipe instructions.
You are responsible for checking all AI-generated content before using it, including:
- whether ingredients are safe for you and anyone you cook for;
- whether foods match allergies, intolerances, religious requirements, ethical preferences, or medical needs;
- whether cooking instructions are safe and complete;
- whether nutrition and cost estimates are reasonable;
- whether any shopping, preparation, or storage instruction is suitable.
SirPrep does not guarantee that AI-generated content will meet your preferences, budget, health needs, or dietary restrictions. You should not include names, addresses, contact details, or other unnecessary personal data in freeform AI prompts.
5. User Obligations
You agree to use SirPrep only lawfully and for personal, non-commercial purposes unless the provider has expressly permitted another use.
You agree not to:
- misuse the App or attempt to disrupt, overload, or bypass its systems, subscriptions, quotas, or security controls;
- submit illegal, harmful, offensive, misleading, confidential, or third-party personal data through the App;
- use the App to generate content that infringes third-party rights or violates applicable law;
- copy, modify, distribute, reverse engineer, decompile, or attempt to extract source code from the App, except where this is expressly permitted by mandatory law;
- use automated scripts, bots, scraping, or similar tools against the App or its backend services.
You are responsible for the information you enter, for decisions you make based on the App, and for maintaining appropriate backups where available. SirPrep's local app data may be lost if you delete the App, reset app data, change devices, disable backups, or experience device failure.
6. Privacy and Data Protection
The processing of personal data is described in the Privacy Policy. The Privacy Policy forms an important part of the App information but is separate from these Terms.
The current App allows you to reset locally stored app data from within the App. Resetting or deleting local data does not automatically cancel App Store subscriptions. Subscription cancellation must be handled through your Apple account settings.
7. Subscriptions, Payments, and SirPrep Pro
SirPrep may offer paid subscription features, including SirPrep Pro. SirPrep Pro currently unlocks paid features such as enhanced or uncapped AI generation within the App, subject to technical availability, fair use, abuse prevention, and any limits shown in the App or App Store purchase flow.
All in-app purchases and subscriptions are processed through Apple's App Store In-App Purchase system. The provider does not directly process your payment card details.
Subscription details:
- The available plans, billing periods, trial offers, prices, currencies, taxes, and renewal terms are shown by Apple before you confirm the purchase.
- Prices may vary by country, currency, tax rules, App Store pricing tiers, and promotional offers.
- Subscriptions automatically renew unless cancelled through your Apple account settings at least 24 hours before the end of the current billing period or free trial, where Apple requires that timing.
- Apple may charge your selected payment method up to 24 hours before the start of the next subscription period.
- If you cancel a paid subscription, you normally keep access to paid features until the end of the already paid billing period.
- If payment cannot be collected, access to paid features may be suspended or end.
Subscription status, purchase validation, paywalls, restore purchases, and entitlement checks may be managed through RevenueCat as described in the Privacy Policy.
8. Cancellation, Refunds, and Right of Withdrawal
You can manage or cancel subscriptions through your Apple account settings. Deleting SirPrep from your device does not cancel a subscription.
Because purchases and subscriptions are processed by Apple, refund requests and any statutory right of withdrawal relating to App Store purchases must generally be handled through Apple, Apple Support, or Apple's "Report a Problem" process at https://reportaproblem.apple.com.
Nothing in these Terms limits any mandatory consumer rights you may have under applicable law, including statutory warranty rights or withdrawal rights for consumers.
9. Availability, Updates, and Changes to the App
The provider aims to keep SirPrep useful and available, but does not guarantee uninterrupted, error-free, or permanent availability. Access may be affected by maintenance, updates, third-party service failures, App Store issues, network problems, device problems, force majeure, or security measures.
The provider may update, improve, modify, replace, suspend, or discontinue features, provided this does not unlawfully deprive paid users of essential paid functionality during an active paid subscription period. Some updates may be necessary for security, compatibility, legal compliance, or continued operation of the App.
You should install updates made available through the App Store, especially security and compatibility updates. Older versions may stop working correctly.
10. License and Intellectual Property
SirPrep, including its software, design, text, graphics, branding, and other content, is protected by intellectual property laws.
Subject to your compliance with these Terms and Apple's applicable usage rules, you receive a limited, non-exclusive, non-transferable, revocable license to use SirPrep for personal purposes on Apple-branded devices that you own or control.
You do not acquire ownership of the App or its intellectual property. All rights not expressly granted remain with the provider or the relevant rights holders.
You retain rights in the information you enter into the App. You grant the provider the limited rights necessary to process that information for operating the App, generating requested AI output, enforcing quotas, providing support, and maintaining app functionality, as described in these Terms and the Privacy Policy.
11. Third-Party Services
SirPrep may rely on third-party services, including Apple, RevenueCat, Supabase, and Google Cloud / Vertex AI / Gemini. These services may be subject to their own terms, policies, technical limits, availability, and processing conditions.
The provider is not responsible for third-party services beyond the responsibility required by applicable law. Third-party service outages or changes may affect SirPrep features.
12. Warranty and Liability
Your mandatory statutory rights, including consumer rights relating to digital products, remain unaffected.
The provider is liable without limitation for:
- intent and gross negligence;
- injury to life, body, or health;
- liability under the German Product Liability Act, where applicable;
- guarantees expressly given by the provider;
- fraudulent concealment of defects.
In cases of slight negligence involving a material contractual obligation, liability is limited to foreseeable, typical damages. Material contractual obligations are obligations whose fulfillment makes proper use of the App possible and on whose compliance you may regularly rely.
Any further liability is excluded to the extent permitted by law.
In particular, to the extent permitted by law, the provider is not liable for:
- medical, dietary, shopping, cooking, or financial decisions made based on App content;
- incorrect AI-generated meals, recipes, ingredients, prices, or nutrition values;
- failure to check allergens, food safety, cooking instructions, or personal suitability;
- data loss caused by device deletion, reset, failure, missing backups, or user action;
- temporary unavailability caused by third-party services, Apple, RevenueCat, Supabase, Google, network providers, or force majeure.
13. Termination and Suspension
You may stop using SirPrep at any time and may delete the App from your device. You may also reset local app data within the App where this feature is available.
Deleting the App or resetting data does not cancel a paid subscription. Subscriptions must be cancelled through Apple.
The provider may suspend or restrict access to features if necessary for security, legal compliance, fraud prevention, abuse prevention, technical integrity, or if you materially breach these Terms.
Sections that by their nature should continue to apply after termination will remain effective, including intellectual property, liability, governing law, and dispute provisions.
14. Age Requirements
SirPrep is not directed to children under 16. If you are under 16, you may use SirPrep only with consent from a parent or legal guardian.
If you use the App on behalf of another person or plan meals for others, you are responsible for ensuring that your use is lawful and that you do not enter personal or sensitive information about others without a valid legal basis.
15. Consumer Dispute Resolution
The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board under the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz, VSBG), unless legally required.
The former European Commission Online Dispute Resolution platform was discontinued on July 20, 2025. Therefore, these Terms do not provide the old ODR platform link used in many older terms templates.
16. Governing Law and Final Provisions
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and mandatory consumer protection law in your country of residence provides stronger protection, those mandatory rights remain unaffected.
If any provision of these Terms is or becomes invalid, the remaining provisions remain valid. The invalid provision will be replaced by the applicable statutory rule.
The provider may update these Terms where necessary, for example due to changes in the App, legal requirements, third-party services, or subscription functionality. The latest version will be identified by the "Last updated" date above.
