These Terms and Conditions govern the use of the mobile application FooDB (the "App"), made available through the Apple App Store.
The provider of the App and your contractual partner is:

FooDB is a mobile application designed for the personal documentation and evaluation of food intake, ingredients, bodily symptoms, and statistical correlations between them. The App utilizes AI-based analysis to assist in identifying ingredients from user-uploaded images and generating personal insights. The App is intended solely for personal self-monitoring and informational purposes.
Not a Medical Device: FooDB is not a medical device within the meaning of the European Medical Device Regulation (Regulation (EU) 2017/745 - MDR).
No Medical Advice: The App does not provide medical advice, diagnosis, or treatment recommendations. All content, evaluations, and analyses are provided strictly for informational purposes.
The App does not replace professional medical consultation. Users must always consult a qualified healthcare professional regarding medical concerns, allergies, or before making significant changes to their diet.
The App provides AI-based algorithmic analysis of user-entered data and images.
Users acknowledge that such analysis is based on statistical models, may be incomplete or inaccurate, and is not medically validated. It does not constitute an individualized medical assessment.
The Provider makes no warranty regarding the accuracy, completeness, or medical suitability of the AI results. The use of AI-based features and any dietary decisions made based on them are strictly at the user's own risk.
The App allows users to enter health-related data (e.g., physical symptoms, dietary intolerances, bodily reactions). The processing of this sensitive data is carried out strictly in accordance with our Privacy Policy and is based on the user's explicit consent.
Lawful Use: Users agree to provide accurate information and refrain from misusing the App or uploading illegal, offensive, or malicious content.
Account Security: Users are responsible for maintaining the confidentiality of their login credentials.
Data Backups: While the Provider strives to keep data secure, users remain solely responsible for creating their own backups of their entered data. The Provider is not liable for data loss.
Access Requirements: Access to core tracking and analysis features—including meal and symptom logging, calendar history, AI analytics, and personalized insights—requires an active subscription. Certain account management, settings, legal compliance, and subscription management screens may remain accessible without an active subscription.
Subscription Plans:
3-Day Free Trial:New users are eligible for a one-time free trial period of three (3) days for either subscription plan. The free trial begins when the subscription is confirmed through the user's Apple ID account.
Billing via Apple:All purchases, subscriptions, renewals, and payments are processed exclusively through Apple's App Store In-App Purchase system. Apple's terms and conditions apply to all payment transactions.
Auto-Renewal and Cancellation:Unless cancelled at least 24 hours before the end of the current subscription period or free trial period, the selected subscription will automatically renew and the applicable subscription fee will be charged through the user's Apple ID account. Subscriptions may be managed and cancelled at any time through the user's Apple account settings.
Refunds: Billing management, cancellation requests, and refund requests must be submitted directly to Apple. The Provider does not process payments and has no control over refund decisions made by Apple.
Price Changes: Subscription prices may vary by country, currency, taxes, exchange rates, or App Store pricing tiers. Users will always be shown the applicable price by Apple before confirming a purchase.
The Provider strives for high availability but does not guarantee uninterrupted access, error-free functionality, or permanent data storage. Technical disruptions, maintenance, or force majeure may affect availability.
The Provider reserves the right to modify features, update content, or discontinue specific services at any time. Users have no legal claim to the continuation of specific features.
The Provider shall be liable without limitation in cases of intent, gross negligence, or injury to life, body, or health.
In cases of slight negligence involving essential contractual obligations (cardinal obligations), liability is limited to foreseeable, typical damages.
Any further liability is excluded to the extent permitted by law. In particular, the Provider is not liable for medical decisions made by users, misinterpretation of AI analysis results, or data loss.
The use of the App requires that the user meets the minimum age required to provide legally valid consent for the processing of health data under applicable data protection laws (e.g., 16 years of age under the GDPR). The App is not directed at children.
All intellectual property rights in the App, including software, code, design, text, and graphics, remain the exclusive property of the Provider. Users are granted a limited, non-transferable, non-exclusive, and revocable license strictly for the personal use of the App.
Governing Law: These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of the user's country of residence remain unaffected.
Severability (Salvatorische Klausel): If any individual provision of these Terms is or becomes legally invalid, the validity of the remaining provisions shall remain unaffected.
Dispute Resolution: The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Because all purchases, subscriptions, and free trials are processed exclusively via Apple (App Store), Apple acts as your contractual partner for the payment process. Therefore, the statutory EU Right of Withdrawal must be exercised directly against Apple.
