Terms of Use for Plasticity

These Terms of Use apply to the Plasticity iPad application ("Plasticity", "the app"). Plasticity is licensed through the Apple App Store under Apple's Standard Licensed Application End User License Agreement. These Terms explain Plasticity's features and supplement that agreement. If these Terms conflict with mandatory consumer law or Apple's Standard EULA, the applicable law and Apple's Standard EULA control.

2. What Plasticity Provides
Plasticity is an iPad notebook for handwritten learning for people aged 16 and older. You can create blank notebooks, import PDFs or images, write with Apple Pencil, search notebook content, convert selected handwriting into editable text, export notebooks as PDFs, and save notebooks locally on your device. Recognition results may contain errors; review converted text before relying on it.
Clay is Plasticity's optional AI tutor. After you grant the required data-sharing permission, Clay can answer typed or spoken questions and add reversible teaching marks to the current page. AI tutoring requires an active subscription and an internet connection. Local notebook features remain available without enabling AI data sharing or purchasing a subscription.
Accounts are optional. You may sign in with Apple, but every feature, including a subscription, works without an account. Plasticity does not provide cloud synchronization; notebooks are stored in the app's local iOS sandbox whether or not you sign in.
3. AI Tutor Permission and Third-Party Processing
Before Clay can send a tutor request, Plasticity presents a disclosure identifying OpenAI and the data sent, together with links to these Terms and the Privacy Policy. Continuing with or without AI accepts these Terms. The separate AI-sharing control is off by default and is not activated by accepting the Terms alone. You must enable it before starting with Clay. You can instead continue without AI.
When you grant permission and ask Clay a question, Plasticity sends the current page image, an optional pasted image, your question, recent conversation, recognized page text (including available text from the previous page), page and tutor-mark context, and an available short learning summary through Supabase to OpenAI. A spoken question is first transcribed using Apple's speech service. Spoken answers may use OpenAI text-to-speech. RevenueCat is used to verify subscription access. Details about the data, providers, purposes, retention, and withdrawal process are available in the Plasticity Privacy Policy.
You can withdraw AI data-sharing permission in Plasticity Settings. Withdrawing permission stops future OpenAI-backed tutor and narration requests. It does not affect local notebook features.
4. Optional Account and Product Emails
If you choose to sign in with Apple, your subscription is linked to your Plasticity account. You can sign out at any time in Settings. The app then attempts to restore subscription access under an anonymous subscriber identifier. If access is missing, use Restore Purchases with the Apple Account used for the purchase. An Apple Account used for Media & Purchases can differ from the account used for Sign in with Apple; switching accounts does not transfer purchase ownership. You can delete your account at any time in Settings > Account > Delete Account. Deleting your account removes it and the related records described in the Plasticity Privacy Policy. It does not delete notebooks or tutor memory on your iPad and does not cancel an App Store subscription. Apple sign-in revocation can require a separate action in Apple settings, which the app explains if needed. Earlier anonymous feedback may need a separate deletion request.
Signing in or supplying a reply address for feedback does not subscribe you to product emails. The current app does not invite new product-email opt-ins. If you agreed to them in an earlier version, you can withdraw the preference saved on your device in Settings > Help & Feedback > Product Emails, or contact the provider to stop the emails.
5. AI Output and Educational Use
Clay's explanations and teaching marks are generated by artificial intelligence. AI output may be incomplete, inaccurate, or unsuitable for a particular assignment. You should review important results and use your own judgment.
Plasticity is an educational tool. It does not provide medical, legal, financial, therapeutic, or other professional advice. Plasticity does not guarantee grades, examination results, or learning outcomes.
6. Subscriptions and Billing
Clay's OpenAI-backed tutoring and narration require a Plasticity subscription. Available plans, prices, billing periods, and any introductory offer are shown by Apple before purchase and may vary by country or currency.
Usage limits. A subscription does not provide unlimited AI requests. The current service limits are 8 tutor requests per 10-minute window, 60 per UTC calendar day, and 800 per UTC calendar month. Spoken narration has separate limits of 48 speech-generation requests per 10-minute window, 360 per UTC day, and 4,800 per UTC month. These windows are independent of your subscription billing date. Usage is counted under the subscriber identifier used for entitlement checks.
These are service requests, not a guaranteed number of questions or completed answers. A single question may require multiple requests, for example for a continuation, repair, or retry, and spoken replies may be generated in several segments. A request that passes the usage check can count even if it later fails or is interrupted. When a limit is reached, the affected AI requests are temporarily unavailable until the relevant window resets; local notebook features remain available and no automatic overage charge is made. Additional short-term security limits can apply to requests from the same network. Changes to paid-service limits remain subject to Section 9 and your statutory rights.
Subscriptions are processed by Apple through your Apple ID and automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel a subscription in your Apple account settings. Deleting Plasticity does not cancel a subscription.
Apple handles App Store billing, ordinary subscription management, and its refund process. Any statutory rights of withdrawal, remedies for defective digital products, price reduction, termination, or reimbursement that apply remain unaffected; Apple's refund process does not replace those rights. Contact the provider for applicable statutory claims as well as Apple for its billing process. You may request a refund through Apple's Report a Problem service or Apple Support. Plasticity does not receive your full payment-card details.
7. Your Content
You retain your rights in the notes, handwriting, imported documents, images, questions, and other content you place in Plasticity. You are responsible for ensuring that you have permission to use imported or pasted content.
When you choose to use Clay, you authorize Plasticity and the providers identified in the Privacy Policy to process the disclosed content only as needed to provide, secure, and troubleshoot the requested AI feature. If you send feedback in Settings, Plasticity may use it to improve the app.
Do not use Plasticity to process content that is unlawful, infringes another person's rights, or is intended to abuse, disrupt, or compromise the app or its providers.
8. Local Storage, Exports, and Backups
Plasticity stores notebooks locally on your iPad and does not currently provide its own cloud backup or synchronization service. Its limited tutor memory stores study sessions and tentative work-check assessments separately on the device. You can pause memory or clear it in Settings > Tutor Memory. Deleting a notebook does not currently clear that separate memory. Clear it separately if you want both removed. You are responsible for maintaining appropriate device backups. Deleting a notebook or uninstalling the app may permanently remove locally stored content, subject to any device backup controlled through your Apple settings.
PDF export is performed on your device. You choose where an exported copy is saved or shared through the system share sheet. Copies outside Plasticity are handled by the destination you choose and are not removed when you delete the original notebook or your Plasticity account. An exported PDF is a rendered copy, not a complete editable notebook backup; reimporting it does not restore the original editable layers or all source-document information.
9. Availability and Changes
We work to keep Plasticity available and reliable, but uninterrupted or error-free operation is not guaranteed. AI, subscription, and account features depend on Apple, RevenueCat, Supabase, OpenAI, network access, and other systems outside our direct control.
Necessary updates, including security updates, remain subject to statutory obligations. During an ongoing supply of digital services, changes beyond those needed to maintain conformity may be made only for a valid reason such as adapting to an operating-system or provider-interface change, preventing a concrete security or abuse risk, or improving performance or accessibility. Such changes must not impose an additional charge, and we will explain them clearly. This is not a general right to remove paid features.
Where § 327r BGB applies and a change impairs access or use more than insignificantly, we will give reasonable advance notice on a durable medium stating the nature and timing of the change and your rights. You may terminate free of charge within 30 days after receiving the notice or after the change takes effect, whichever is later, unless you can continue using the unchanged service without additional cost as provided by law. Other statutory remedies remain available. A notice only on a changeable web page is not a substitute for a required durable-medium notice.
10. Acceptable Use
You may use Plasticity only in accordance with applicable law, Apple's usage rules, and these Terms. You may not attempt to reverse engineer, disrupt, overload, bypass access controls for, or gain unauthorized access to Plasticity or its connected services, except where applicable law expressly permits such activity.
11. Intellectual Property
Plasticity's software, interface, illustrations, branding, and original content are protected by intellectual-property laws. Except for the license granted under Apple's Standard EULA, no ownership rights in Plasticity are transferred to you.
12. Warranty and Liability
Apple's Standard EULA contains warranty and liability provisions that apply to the app. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intent, gross negligence, injury to life, body, or health, or mandatory consumer rights.
Your statutory rights concerning defective digital products, including conformity, updates and applicable remedies under §§ 327 et seq. BGB, remain unaffected. The warnings about AI accuracy and local backups do not exclude liability for breach of an essential contractual duty or other liability that cannot lawfully be excluded.
13. Privacy
The Plasticity Privacy Policy explains how data is processed, which providers receive it, how long it may be retained, and how you can withdraw AI data-sharing permission or exercise data-protection rights.
14. Minimum Age
You must be at least 16 years old to use Plasticity. If you are 16 or 17, you must have permission from a parent or legal guardian, and ask them to read these Terms with you. Purchases also require any authorization required under applicable law. Parental permission does not make the app available to children under 16.
On the privacy screen, including on existing installations that have not completed age confirmation, you must enable an initially off age-confirmation control. It states that you are at least 16 and explains that, if you are under 18, a parent or guardian must have read the Terms and agreed. You must answer accurately. People under 16 cannot truthfully make this declaration. This is a self-declaration, not identity-document verification or independent verification of parental permission.
Age confirmation is separate from AI-sharing permission, acceptance of these Terms, and any product-email preference saved in an earlier version. An age restriction does not delete existing notebooks or cancel a subscription. For an existing subscription, use your Apple Account subscription settings. Contact the provider for help with an existing account or a data-rights request.
15. Ending Use
You may stop using Plasticity at any time. You can withdraw AI data-sharing permission in Settings, stop product emails in Settings, delete your account in Settings if you created one, manage or cancel a subscription through Apple, and remove locally stored notebooks by deleting them or uninstalling the app.
Access to connected services may be restricted where reasonably necessary for security, fraud prevention, legal compliance, misuse, or a material breach of these Terms.
16. Governing Law
Applicable law and jurisdiction are determined by Apple's Standard EULA and mandatory consumer-protection rules. If you live in the European Union, Switzerland, Norway, or Iceland, the law and courts of your usual place of residence generally apply under Apple's Standard EULA.
17. Changes to These Terms
These Terms may be updated when Plasticity's features, subscriptions, providers, or legal obligations change. The current version is identified by the “Last updated” date above. Material changes will be communicated where required by law. Merely publishing a new version does not change an existing agreement or constitute your consent to new processing. Where agreement is legally required, we will obtain it. The service-change rules in Section 9 and mandatory consumer protections remain applicable.
