Terms of Use for Plasticity

These Terms of Use apply to the Plasticity iPad application ("Plasticity", "the app"). Plasticity is licensed through the Apple App Store under Apple's Standard Licensed Application End User License Agreement. These Terms explain Plasticity's features and supplement that agreement. If these Terms conflict with mandatory consumer law or Apple's Standard EULA, the applicable law and Apple's Standard EULA control.

2. What Plasticity Provides
Plasticity is an iPad notebook for handwritten learning. You can create blank notebooks, import PDFs or images, write with Apple Pencil, and save notebooks locally on your device.
Clay is Plasticity's optional AI tutor. After you grant the required data-sharing permission, Clay can answer typed or spoken questions and add reversible teaching marks to the current page. AI tutoring requires an active subscription and an internet connection. Local notebook features remain available without enabling AI data sharing or purchasing a subscription.
Plasticity does not provide user accounts or cloud synchronization. Notebooks are stored in the app's local iOS sandbox.
3. AI Tutor Permission and Third-Party Processing
Before Clay can send a tutor request, Plasticity presents a disclosure identifying the data sent and the third-party providers involved. You must select the unchecked permission box stating, “I agree that Plasticity may send the information described above through Supabase to OpenAI to provide Clay’s AI features,” before you can continue.
When you grant permission and ask Clay a question, Plasticity sends the disclosed current-page and question data through Supabase to OpenAI. RevenueCat is used to verify subscription access. Details about the data, providers, purposes, retention, and withdrawal process are available in the Plasticity Privacy Policy.
You can withdraw AI data-sharing permission in Plasticity Settings. Withdrawing permission stops future OpenAI-backed tutor and narration requests. It does not affect local notebook features.
4. AI Output and Educational Use
Clay's explanations and teaching marks are generated by artificial intelligence. AI output may be incomplete, inaccurate, or unsuitable for a particular assignment. You should review important results and use your own judgment.
Plasticity is an educational tool. It does not provide medical, legal, financial, therapeutic, or other professional advice. Plasticity does not guarantee grades, examination results, or learning outcomes.
5. Subscriptions and Billing
Clay's OpenAI-backed tutoring and narration require a Plasticity subscription. Available plans, prices, billing periods, and any introductory offer are shown by Apple before purchase and may vary by country or currency.
Subscriptions are processed by Apple through your Apple ID and automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel a subscription in your Apple account settings. Deleting Plasticity does not cancel a subscription.
Apple handles billing, cancellations, and refund requests. You may request a refund through Apple's Report a Problem service or Apple Support. Plasticity does not receive your full payment-card details.
6. Your Content
You retain your rights in the notes, handwriting, imported documents, images, questions, and other content you place in Plasticity. You are responsible for ensuring that you have permission to use imported or pasted content.
When you choose to use Clay, you authorize Plasticity and the providers identified in the Privacy Policy to process the disclosed content only as needed to provide, secure, and troubleshoot the requested AI feature.
Do not use Plasticity to process content that is unlawful, infringes another person's rights, or is intended to abuse, disrupt, or compromise the app or its providers.
7. Local Storage and Backups
Plasticity stores notebooks locally on your iPad and does not currently provide its own cloud backup or synchronization service. You are responsible for maintaining appropriate device backups. Deleting a notebook or uninstalling the app may permanently remove locally stored content, subject to any device backup controlled through your Apple settings.
8. Availability and Changes
We work to keep Plasticity available and reliable, but uninterrupted or error-free operation is not guaranteed. AI and subscription features depend on Apple, RevenueCat, Supabase, OpenAI, network access, and other systems outside our direct control.
Plasticity may be updated to improve security, reliability, compatibility, or features. Specific features may change or be discontinued where reasonably necessary. Mandatory consumer rights remain unaffected.
9. Acceptable Use
You may use Plasticity only in accordance with applicable law, Apple's usage rules, and these Terms. You may not attempt to reverse engineer, disrupt, overload, bypass access controls for, or gain unauthorized access to Plasticity or its connected services, except where applicable law expressly permits such activity.
10. Intellectual Property
Plasticity's software, interface, illustrations, branding, and original content are protected by intellectual-property laws. Except for the license granted under Apple's Standard EULA, no ownership rights in Plasticity are transferred to you.
11. Warranty and Liability
Apple's Standard EULA contains warranty and liability provisions that apply to the app. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intent, gross negligence, injury to life, body, or health, or mandatory consumer rights.
To the extent permitted by law, Plasticity is not responsible for decisions made solely in reliance on AI output, loss caused by unlawful use of third-party content, or loss of locally stored notebook data where the app operated as described and no mandatory liability applies.
12. Privacy
The Plasticity Privacy Policy explains how data is processed, which providers receive it, how long it may be retained, and how you can withdraw AI data-sharing permission or exercise data-protection rights.
13. Age and Parental Supervision
Plasticity is an educational tool that may be used by learners under 16. If you are under 16, use Plasticity and make any purchase only with the permission and supervision of a parent or legal guardian.
14. Ending Use
You may stop using Plasticity at any time. You can withdraw AI data-sharing permission in Settings, manage or cancel a subscription through Apple, and remove locally stored notebooks by deleting them or uninstalling the app.
Access to connected services may be restricted where reasonably necessary for security, fraud prevention, legal compliance, misuse, or a material breach of these Terms.
15. Governing Law
Applicable law and jurisdiction are determined by Apple's Standard EULA and mandatory consumer-protection rules. If you live in the European Union, Switzerland, Norway, or Iceland, the law and courts of your usual place of residence generally apply under Apple's Standard EULA.
16. Changes to These Terms
These Terms may be updated when Plasticity's features, subscriptions, providers, or legal obligations change. The current version is identified by the “Last updated” date above. Material changes will be communicated where required by law.
